Magicseaweed is a brand operated by Wavetrak Limited, an entity based in the United Kingdom (“Surfline UK”). Wavetrak Limited is a wholly owned subsidiary of Surfline\Wavetrak, Inc., a corporation registered in Delaware, United States of America (“Surfline US”). This privacy policy is issued on behalf of Surfline UK and Surfline US so when we mention "Surfline", "we", "us" or "our" in this privacy policy, we are referring to the relevant company in the Surfline group of companies responsible for processing your data.
Any use of Surfline’s services under the “Magicseaweed” brand is expressly subject to the Magicseaweed Terms of Use.

Future transfer of data assets between Surfline UK and Surfline US
As of the date this Privacy Policy was last updated, the personal data of individuals using the Magicseaweed branded Services is collected and controlled by Surfline UK. In the future, certain assets of Surfline UK (including personal data) may be transferred to Surfline US (“Transfer”). In the event such Transfer occurs, we will notify impacted users and you will have the opportunity to exercise any rights you may have, including the ability to opt-out of having your personal data included in such transfer. After such Transfer takes effect, personal data of individuals using the Magicseaweed branded Services will be collected and controlled by Surfline US on a go forward basis. Until such Transfer is complete, there may be a period of time where personal data is controlled and processed by both Surfline UK and Surfline US. We have mechanisms in place to enable the lawful and secure processing of personal data by both entities.

Aggregated Data
We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific Service feature. However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.
We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.
If you fail to provide personal data
Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

ANNEX A: PRIVACY INFORMATION FOR U.S. RESIDENTS
This Annex A is adopted to comply with the California Consumer Privacy Act (CCPA) and any terms defined in the CCPA have the same meaning when used in this Annex A. If you reside in another state with similar rights, we will comply with those rights accordingly and as described in this Annex A.
Sales or Sharing of Personal Information
We may sell or share your digital activity information with third parties in order to receive information about the performance of our marketing campaigns and usage statistics related to our sites or applications. This activity may constitute a “sale” or “share” under the CCPA. If you are a resident of certain states, including California, you may have the right to opt-out from the “sale” or “share” of personal information in this manner. To our knowledge, our personal information sales and sharing do not include information about individuals we know are under age 16. We have sold or shared personal information to advertising service providers such as Facebook and Google in the last twelve (12) months.
